APOLOGIES FOR ABSENCE
There were no apologies for absence received from Members of the Board.
2.
EXCLUSION OF THE PUBLIC AND PRESS
RESOLVED: That the public and press be excluded from the meeting before discussion takes place on the following item of business to be considered on the grounds that, if the public and press were present during the transaction of such business, there would be a disclosure to them of exempt information as described in paragraphs 1 and 2 of Schedule 12A to the Local Government Act 1972, as amended.

HACKNEY CARRIAGE AND PRIVATE HIRE LICENSING
The Assistant Chief Executive, Legal and Governance, submitted details in respect of four cases relating to Hackney Carriage and Private Hire Licensing. The applicants in respect of Case Nos.39/06 and 41/06 attended the meeting.
RESOLVED: That the cases now submitted be determined as follows:-

Hackney Carriage and Private Hire Driver's Licence
Refuse on the grounds that the applicant is not a fit and proper person by reason of the offences now reported and the applicant's responses to the questions of the Members of the Board relating thereto.

Hackney Carriage and Private Hire Driver's Licence
Defer consideration to enable the applicant to be represented and the hearing of an application for the re-opening of a conviction to take place on 30th June, 2006.

Hackney Carriage Vehicle Licence and Hackney Carriage and Private Hire Driver's Licence
(a) Grant the Hackney Carriage Vehicle Licence for an initial period of 4 months with the vehicle undertaking the Council's taxi test at the end of that period and with any failure to be referred to the Board;
(b) the Assistant Chief Executive, Legal and Governance be given authority to grant the Hackney Carriage Vehicle Licence for two further periods of four months with the vehicle undertaking the Council's taxi test at the end of each of these periods and with any failure to be referred to the Board;
(c) the application for the Hackney Carriage Vehicle Licence at the end of the 12 month period to be referred to the Board;
(d) the applicant be given a written and verbal warning with regard to the maintenance of this vehicle and the provision of records in relation thereto; and
(e) in relation to the Hackney Carriage and Private Hire Driver's Licence, the applicant be given a written and verbal warning as to his future conduct.
