2. | EXCLUSION OF THE PUBLIC AND PRESS | |||
| RESOLVED: That the public and press be excluded from the meeting before discussion takes place on the following item of business to be considered on the grounds that, if the public and press were present during the transaction of such business, there would be a disclosure to them of exempt information as described in paragraphs 1 and 2 of Schedule 12A to the Local Government Act 1972, as amended. | |||

3. | HACKNEY CARRIAGE AND PRIVATE HIRE LICENSING | |||
| The Assistant Chief Executive, Legal and Governance, submitted details in respect of three cases relating to Hackney Carriage and Private Hire Licensing. The applicants in respect of Case Nos. 27/06 and 35/06 attended the meeting and the applicant in respect of Case No. 27/06 was accompanied by a friend, whilst the applicant in respect of Case No. 35/06 was accompanied by the Acting Chairperson of the Sheffield Taxi Trade Association and a representative who presented the case on the applicant's behalf. | |||
| RESOLVED: That the cases now submitted be determined as follows:- | |||

| 27/06 | Private Hire Operator's Licence | (a) Defer for a second time (up to a maximum period of three months) to enable the applicant to seek legal advice on certain aspects of the application on the lines now discussed; and | |

| 28/06 | Hackney Carriage and Private Hire Driver's Licence | It be noted that the applicant has withdrawn his application. | |

| 35/06 | Hackney Carriage and Private Hire Driver's Licence | (a) After careful consideration of the representations now made by the applicant for the case to be deferred for a second time to enable the applicant's Solicitor to attend, the Board considered that the case should be heard; and |
| | | (b) after careful consideration of the information now provided by two witnesses, no action be take to suspend or revoke the Hackney Carriage and Private Hire Driver's Licence, but the applicant be given a strong warning as regards his future conduct. |
4. | LICENSING ACT 2003 |

| The Assistant Chief Executive, Legal and Governance, submitted a report on an application made under the provisions of Section 17 of the Licensing Act 2003 for a premises licence in respect of Pete's Corner Stores, 287 Shoreham Street, Sheffield S2 4FA. |
| The Licensing Officer reported that all the outstanding issues in relation to the application had been satisfactorily resolved prior to the meeting. |
| RESOLVED: That the information now reported, that all the outstanding issues in relation to the application for a premises licence in respect of Pete's Corner Stores, 287 Shoreham Street, Sheffield S2 4FA have been satisfactorily resolved in accordance with the provisions of the Licensing Act 2003 prior to this hearing, be noted. |

| The Assistant Chief Executive, Legal and Governance, submitted a report on an application made under the provisions of Section 34 of the Licensing Act 2003 for a variation to the premises licence in respect of premises at Bar Matrix, Unit 2-4 Charter Square, Sheffield S1 4HS. |
| The Licensing Officer reported that all the outstanding issues in relation to the application had been satisfactorily resolved prior to the meeting. |
| RESOLVED: That the information now reported, that all the outstanding issues in relation to the application for a variation to the premises licence in respect of premises at Bar Matrix, Unit 2-4 Charter Square, Sheffield S1 4HS have been satisfactorily resolved in accordance with the provisions of the Licensing Act 2003 prior to this hearing, be noted. |
