Town And Country Planning Act 1990 Section 257, Proposed Closure Of Footpath Off Knutton Rise, Parson Cross, Sheffield.

Minutes:

6.1

The Director of Culture and Environment submitted a report to seek authority to process the Public Path Closure Order required to close the footpath (that has no formal status) between Knutton Rise and Public Footpath ECC\117 in the Parson Cross area of Sheffield.

 

6.2

In order to enable a development to be carried out, it was felt necessary to close the footpath which ran through the site. Though the path had no legal status, it was considered prudent to make a formal closure application. If the application was successful it would prevent any public rights from being established across the site.

 

6.3

Consultations had been carried out with Statutory Undertakers (i.e. utility companies), the Emergency Services, and other relevant bodies, including footpath societies.  No objections had been received.

 

6.4

RESOLVED: That;

 

(1)   no objections be raised to the proposed closure of the footpath off Knutton Rise, subject to satisfactory arrangements being made with Statutory Undertakers in connection with any of their mains and services that may be affected.

 

(2)   Authority be given to the Director of Legal and Governance to:

 

(i)             take all necessary action to close the footpath by order under the powers contained within Section 257 of the Town and Country Planning Act 1990.

 

(ii)            confirm the order as an unopposed order, in the event of no objections being received, or any objections received being

resolved and withdrawn, prior to the order being confirmed.
