Minutes:

4.1

The Chief Licensing Officer submitted details in respect of four cases relating to hackney carriage and private hire licensing.

 

 

4.2

The licence holder in Case No.26/24 attended the hearing with two representatives, and they all addressed the Sub-Committee.

 

 

4.3

The applicant in Case No.27/24 did not attend the hearing and had requested that the hearing be deferred.

 

 

4.4

The applicant in Case No.28/24 attended the hearing and addressed the Sub-Committee.

 

 

4.5

The applicant in Case No.29/24 did not attend the hearing and had not provided reasons for his absence.

 

 

4.6

RESOLVED: That after consideration of the information contained in the case papers, and the information now reported and, where relevant, circulated either prior to the meeting, but after publication of the agenda, or at the meeting, the cases now submitted be determined as follows:-

Review of a Private Hire and Hackney Carriage Driver’s Licence

The licence holder be (a) issued with a warning as to his future conduct, to remain live on his licence for a period of 24 months, stating that, should there be any further causes for concern, the licence would be referred back to the Sub-Committee; and (b) required to complete the Level 2 Certificate in the Introduction to the Role of the Professional Taxi and Private Hire Driver, within 6 months of the date of the hearing.

Application to be exempted from certain conditions of a Private Hire Vehicle Licence

Defer consideration of the case, with the applicant being granted one further opportunity to attend a hearing to present his case.

Application to be exempted from certain conditions of a Hackney Carriage Vehicle Licence

Grant the exemption as requested, subject to the conditions that (a) the front passenger seat must only be used when all other seats in the rear of the vehicle are in use, or where it is being used by persons with mobility issues and they choose to enter the front of the vehicle; and (b) the vehicle’s CCTV system must be of an approved standard as designated by the Council and be operational and recording at all times that the vehicle is being used for licensable purposes.

(b)  the Waste and Street Scene Policy Committee be recommended to review the existing policy on the licensing of front passenger seats in hackney carriage vehicles.
